Terms of Service

1. About these terms

These Terms of Service govern your use of TopJob, a service operated by Horner Systems, a sole trader business run by James Horner, based in West Yorkshire, United Kingdom.

By subscribing to or using TopJob, you agree to these terms. Please read them carefully. If you do not agree, do not use the service.

These terms apply to business customers — the sole traders and small business owners who subscribe to TopJob. If you are a member of the public who received an SMS via TopJob, please see our Privacy Policy.

2. The service

TopJob provides an automated missed-call lead capture service. When a call to your number goes unanswered, TopJob automatically sends an SMS to the caller inviting them to describe their enquiry, and simultaneously plays a voicemail greeting giving the caller the option to leave a message. SMS replies and voicemails are presented to you in your TopJob dashboard — including the raw transcript and an AI-generated summary to help you assess the enquiry quickly.

The service includes:

  • Automated SMS reply to missed calls
  • AI-powered lead classification and enrichment
  • A web-based dashboard to view and manage leads
  • Owner notifications via SMS when new leads arrive
  • Lead history and archiving
  • Voicemail recording, transcription, and AI analysis
  • The ability to pause and resume the service

3. Your subscription

TopJob is a subscription service billed at £29.99 per month. All prices include VAT where applicable. Customers who subscribe during our founding period will retain this price for the life of their current plan — price changes apply to new subscriptions only. If VAT registration becomes required in future, VAT may be added to all prices including founding cohort pricing.

Your subscription begins with a 14-day free trial. No payment is taken during the trial period. At the end of the trial, your subscription will automatically continue and your payment method will be charged unless you cancel before the trial ends.

Payments are processed by Stripe. By subscribing, you authorise recurring monthly charges to your payment method. You will receive a receipt from Stripe for each payment.

Your subscription renews automatically each month on the same date. If a payment fails, we will notify you and your account may be suspended until payment is resolved.

4. Cancellation and refunds

You may cancel your subscription at any time. To cancel, go to Settings in your TopJob dashboard and select Cancel subscription, or email hello@topjobapp.com.

When you cancel, your account will remain active until the end of your current billing period. You will not be charged again after that date. We do not offer partial refunds for unused time within a billing period.

If you cancel during your free trial, you will not be charged at all.

In exceptional circumstances (such as a significant service outage caused by us), we may offer a refund or credit at our discretion. Please contact us to discuss.

5. Your responsibilities

By using TopJob, you agree to:

  • Provide accurate information when setting up your account
  • Keep access to your account secure. You may invite team members through the built-in access controls rather than sharing direct access.
  • Use the service only for legitimate business purposes
  • Not use the service to send unsolicited or misleading messages to callers
  • Comply with all applicable UK laws, including data protection law, when handling lead data you receive through TopJob
  • Not attempt to circumvent, reverse engineer, or otherwise interfere with the service

You are responsible for how you use the lead data provided to you. TopJob captures and presents enquiries — what you do with them is your responsibility.

6. SMS communications

TopJob sends SMS messages to callers on your behalf using your designated Twilio number. By using TopJob, you authorise us to send these messages in your name.

You must not use TopJob to contact individuals who have opted out of receiving SMS messages. Our system automatically honours opt-out requests (STOP replies) and you must not attempt to circumvent this.

SMS message costs are included in your subscription fee. In cases of unusually high usage, we reserve the right to contact you to discuss continued service.

Where callers leave a voicemail, that recording is processed by Twilio and transcribed using OpenAI's Whisper service. Voice transcriptions may contain errors and should not be treated as verbatim records. Recordings are stored securely and deleted automatically after 90 days.

7. Availability and service levels

We aim to provide a reliable service but we do not guarantee 100% uptime. TopJob depends on third-party infrastructure including Twilio, Supabase, OpenAI, and Vercel. Outages in these services may affect TopJob's availability.

We will make reasonable efforts to notify you of planned maintenance or known outages. We are not liable for missed calls or lost leads resulting from service interruptions beyond our control.

We reserve the right to modify, update, or discontinue features of the service with reasonable notice where possible.

8. Limitation of liability

TopJob is a tool to help you capture and organise enquiries. We make no guarantee that using TopJob will result in new business, bookings, or revenue.

To the fullest extent permitted by UK law, Horner Systems shall not be liable for:

  • Loss of business, revenue, profits, or contracts
  • Missed leads resulting from service outages or technical failures
  • The accuracy of AI-generated lead classifications
  • The accuracy of AI-generated voice transcriptions
  • Actions taken by you based on lead information provided by TopJob
  • Any indirect or consequential loss

Our total liability to you in any month shall not exceed the subscription fee paid by you in that month.

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

9. Intellectual property

TopJob, including its software, design, and content, is the intellectual property of Horner Systems and is protected by UK copyright law. You may not copy, reproduce, or redistribute any part of the service without our written permission.

The data you receive through TopJob (lead information from your callers) belongs to you. We do not claim ownership of your business data.

10. Account termination

We reserve the right to suspend or terminate your account if you breach these terms, use the service fraudulently, or engage in behaviour that harms other users or callers.

If we terminate your account for cause, we are not obliged to issue a refund.

On termination of your account, your data will be retained for 30 days and then deleted, unless you request earlier deletion.

11. Changes to these terms

We may update these terms from time to time. We will notify you by email at least 14 days before significant changes take effect. Continued use of TopJob after that date constitutes acceptance of the updated terms.

The date at the top of this page shows when the terms were last updated.

12. Governing law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of TopJob shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Schedule 2 — Data Protection

This schedule sets out the data protection obligations between Horner Systems (trading as TopJob) and you as a subscribing business, and has effect from the date you accept these Terms. It is drafted on a controller-to-controller basis, reflecting that both parties make independent decisions about how caller personal data is used.

14.1 Controller roles

TopJob acts as an independent data controller in respect of caller personal data — determining the purposes and means of collection, outreach, AI processing, and delivery of leads. You act as a separate, independent data controller in respect of your own subsequent use of the leads TopJob delivers to you (contacting callers, quoting, record-keeping, and any further communication).

Each party is responsible for its own compliance with UK GDPR and PECR in relation to its own processing activities. Neither party acts as data processor for the other in respect of caller data.

14.2 Lawful basis

TopJob relies on Article 6(1)(f) legitimate interests as its lawful basis for processing caller data. You are responsible for identifying and documenting your own lawful basis for any processing you carry out as a separate controller after receiving a lead.

14.3 Use of caller data

You may use caller data delivered through TopJob for the purpose of responding to the enquiry — contacting the caller, providing a quote, and arranging work. You must not use caller data for your own direct marketing purposes without your own independent lawful basis and compliance with PECR. You must not share caller data with third parties beyond what is necessary to carry out the work enquired about.

14.4 Transparency

TopJob provides callers with a privacy notice at topjobapp.com/privacy and includes a link to it in every outreach SMS. You are responsible for your own transparency obligations in respect of any processing you carry out as a separate controller.

14.5 Data subject rights

Each party handles rights requests (access, erasure, objection, rectification) relating to its own processing. Where TopJob receives a rights request that relates to data you hold as a separate controller, TopJob will forward it to you within 5 working days. You must action any such forwarded request within the statutory period and notify TopJob that you have done so. Where you receive a rights request that may relate to data TopJob holds, you should direct the individual to hello@topjobapp.com.

14.6 Security and breach notification

Each party is responsible for maintaining appropriate security measures for the data within its own control. If TopJob becomes aware of a personal data breach affecting caller data it holds, TopJob will notify you without undue delay and in any case within 48 hours of becoming aware. You are responsible for making your own ICO notification if required. If you become aware of a breach affecting caller data you hold, you must notify TopJob and the ICO as required by law.

14.7 Sub-processors

TopJob uses the sub-processors listed in the Privacy Policy (section 7) to operate the service. These are TopJob's own processors, used in the course of TopJob's independent controller activities. TopJob will maintain appropriate contractual terms with each.

14.8 Retention and deletion

TopJob's retention schedule is set out in the Privacy Policy (section 8) and applies to data TopJob holds as controller. You are responsible for your own retention and deletion obligations in respect of data you hold. On cancellation of your subscription, TopJob will delete all caller data it holds within 30 days unless required by law to retain it.

14.9 Excluded sectors

The Service is not available to health, clinical or therapeutic services. You confirm that your business does not provide, and you will not use the Service in connection with, physiotherapy, osteopathy, chiropractic, counselling or psychotherapy, medical, dental, podiatry, addiction or sexual health services, or any treatment with a medical element. This is because enquiries to such services consist of health information, which we are not permitted to process. If your business changes so that this ceases to be true, you must tell us and stop using the Service.

14.10 Message content

You must not use any customisable part of the Service to send promotional, advertising or offer content to callers. Messages sent by the Service on your behalf are service communications responding to a missed call, and any material promoting your goods, services, prices or offers is prohibited. We may revert or remove any content that breaches this, and you are responsible for any claim, complaint or penalty arising from content you supply.
